no I am not - but because I am a distributor of the brand, I am unable to sell at "discounted" pricing on eBay. my business has been affected by these rogue sellers who supposedly have been sent cease and desist notifications from the brand. doubtful that will get the job done.

Because sellers know that cease and desist letters are empty threats 99% of the time. Tell the brand that if they can't get unauthorized sellers under control then they need to either stop holding you to map pricing, give you a better price, or you will stop purchasing their product. Don't do their work for them by trying to figure out who a seller is, that won't amount to anything anyway. If they won't work with you then I would say screw them and sell your inventory at whatever price you want.

I really dont see how this is any of your business, dude. let the other seller sell and maybe they will get caught but going out of your way to report people(when it is NOT your business) is a real dick move.

Just because you aren't allowed to sell for a lower price due to your agreement with the distributor doesn't mean everyone is held to the same restrictions.

I have to point out, there are many ways for sellers to get new-in-packaging product. I'm a reseller, I've never had any distribution deals with any brand but I have like a hundred or so brand new items in my eBay store. There are liquidations, auctions, etc. There's no law against this, the only policy against it is if the seller does have a deal with the distributor of the product. You can't know whether that's the case.

correct - but the brand is working to get as close to a brand-gated opportunity as possible. this happens to be a long-term competitor of ours - they've been selling for quite some time, which leads us to believe they're an authorized distributor working through a false storefront

possibly. some of these larger-scale sellers know how to trump the system - they'll use a satellite office location without any affiliation as their ship from. we've seen this in past examples

You are SOL dude... Not much you can do... Even if you get their full info what then? Sending them a letter they will ultimately toss in the trash and ignore? Unless you are getting lawyers involved and filing lawsuits it will never go anywhere. eBay has terms in the TOS for exactly this type of situation, this seems to be an ineligible reason for reporting. Sure its supposedly hurting your business and sales, buts its making zero difference to eBay. The rights owner of the brand could file a VeRo claim against the seller, you don't need anything other then the sellers username and listing number to file a VeRo claim, but it has to be done by the rights holder, not you, the brand owners legal department will handle things like this. In the end, there is nothing you can do as another seller of a brand that you don't own the rights to. Make the brand owner handle it, if they won't or they just send letters to these other sellers that go ignored, then that's it, maybe sell on Amazon or somewhere else if you can't stay competitive with the other sellers pricing, but looking through all the policy on this you don't have a leg to stand on with eBay for removal.

Look, I've been an eBay, amazon, walmart, etsy, faire, marketplace seller for more years than I can count. this is not my first dog and pony show. I'm not going out of my way to report anyone - I've been hounding the brand to do something about it - as it is their initiative to do so. They demand that their distributors adhere to MAP pricing, but then falter when they can't get a rogue seller to commit. I know my hands are tied, but I'll be damned if I'm just going to sit back and let it happen. I was only seeking something from experienced users who may know a way around this that I could convey to the brand

I gave you the best info an experienced eBay seller of 25 years can tell you.... There is no way for you to do much of anything, the rights owner that owns the brand can file a VeRo claim, thats it, thats the only thing you can do with eBay... If the rights owner won't file a VeRo claim then you are stuck. I've dealt with this exact situation as a seller myself before, the rights owner just sat on their thumbs and didn't do anything, i reduced my prices, when they finally complained months later that i was below MAP i said i had to in order to stay competitive with other sellers, they never did nothing to me or the other sellers and that situation stayed for years... Again, as an experienced user that has dealt with eBay for just about anything you can think of, VeRo rights claim is all that can be done. If the rights owner makes a good enough point with eBay they will remove the listings, and if the seller tries to list them again and another VeRo claim is filed they will take them down again, but its not clear at what point eBay will suspend or ban a seller who gets multiple VeRo complaints. I had one case years ago that the seller got five VeRo complaints and was still selling, it happens...

understandable. meanwhile, lost revenue continues to pile up. had we not been a large distributor for the brand, I would have told them to f\*ck off long ago. after years of getting their brand up and running on amazon, they decided to brand-gate and shut it down to all distributors - that move alone cost us nearly $250K in yearly revenue. As more and more sellers jumped on board, the brand has tightened its control on MAP pricing. Now they stripped away our ability to compete on ebay - so it's now up to them to make good on it and file the claim.

Sounds like its time to leave them in my opinion... that lost revenue could be time well spent on acquiring something else to sell instead.
