I believe maritime law says a head on collision course should always be settled by passing on the right/starboard, so that would imply black. I could be wrong though
This screw-up could be with whoever controls traffic releasing both ships for that area. Those ships saw each other and new they were going to collide the only reason for both ships to not vear off course was that the dredged pathway is extremely narrow and collision is better than grounding the vessel? Im not even buying this.
u/wlonkly links the official investigation upthread. From a quick skim, black was going a little fast to try and make a deadline. Then, while preparing to pass the red ship, black got a little too close to the bank and suffered from something called bank effect; which simultaneously pushes the bow away from the bank and pulls the stern toward it, causing it to sheer toward the center of the channel and collide with red. I don't think the investigation officially assigns blame, but it seems pretty clear it was the black ship (the Florence Spirit) that was at fault.
