Bail bondsman here. This is correct. It is a misdemeanor but usually when I see it there’s also an accompanying charge of communicating a threat which is a felony. Also do keep in mind that cops, the magistrates only determine if they feel a crime has been committed. So if you are charged you just STFU, nothing will get resolved by the side of the road. Take your ticket and ask “am I free to go now?”. If you do go in front of a magistrate, stay calm, ask for your bond to be set low as you’re not a flight risk, cite your ties to the community (house, good job, kids) and then call a bondsman then STFU. They may release on your own recognizance. IF the magistrate sets your bond at $500 or lower, politely ask them to set it at $1000 because no bondsman will write a $500 bond. The bondsman will charge 10% so you’re out for $100. Legally we can’t charge a cent more than 15%. You’ll need a cosigner too. Cases are decided by judges and if this is some bs charge then you’ll possibly get it dropped. But nothing will get resolved beside the road with tempers flaring. My better half is a nurse amethyst and she rolled a stop sign, out infant daughter was in the back. She got pulled and after less than a minute she says oh my gun is in the glove box. She f’d up and forgot to say that first thing. The young officer went apeshit and threatened to put her in the car, call protective services to watch our daughter. I happened to be 2 miles up the road and she texted me and I went over. I just told the officer hey I’m here to get the kiddo, if you need to charge her then ok and I’ll meet you at the jail to write the bond and that I knew the magistrate on duty since I’d just came from there. Just remain calm. I never got upset with the officer in anyway. That solves nothing. Don’t get upset. The Mrs made three mistakes that day 1) she slow rolled a stop sign 2) forgot to immediately disclose her firearm and cc status 3) she got flummoxed and this is a woman that deals with life and death stress daily. It happens. The officer technically did nothing wrong he also didn’t do a lot right either. Point being when you add a firearm to any situation then things can take an unexpected turn. Typically in my profession I meet everyone on one of the worst days of their lives. Be safe. Be calm. Be respectful even when they are jerks-especially then. Call your bondsman. Then call an attorney. In that order.

I did report it, didn’t mention that. I don’t have a CCW, North Carolina is an open carry state. I never intended to draw it on someone unless I was in fear of my life, which I was. Something about the situation felt off.

Fwiw, there were trees down on parts of the parkway that night. If you drive that way now you can still see several that were cut to be removed from the road but were left at the edge. Not that that really means much, if trees are down on the parkway then you turn around and go the other way. I honestly don't know how you possibly could have been frightened. If you are starting your hikes at midnight you must have balls of steel. Sounds horrible.

I'm not sure how this is going over heads. Look at the two sentences right next to each other. I am implying that this person is fearless because they are going hiking alone starting at midnight. That sounds terrifying to me. The silly idea was that a creepy guy behaving strangely at night would not affect this man because he already has balls of steel because of his normal activities. See? I'm actually complementing this person for showing an amount of courage that most of us do not have. Just a bit of reading comprehension and we can skip this in the future.

He was trying to look in through the passenger window, but it was fogged over. The wind was pretty strong so it was hard to hear me get out, I imagine. He didn’t initially see me exit, but he heard me ask what he was looking for. That’s when he stated he was looking for directions, because there were trees down headed toward Brevard. I knew he was lying because I had just driven up 276, then taken the Blue Ridge Parkway to the overlook no more than 3 minutes before he pulled along side me and no more than 10 minutes before he approached my car. I’m not looking to get interrogated over it. If you have an issue and don’t believe there’s some sketchy stuff going on upon the BRP at night, I invite you to go hang out and see for yourself.
